Welcome to Foundry 4. These Terms and Conditions (“Terms”) govern your use of our website, services, and products. By accessing or using our platform, you agree to comply with and be bound by these Terms. If you do not agree, please refrain from using our services.
1. Definitions
“We”, “Us”, “Our” refer to Foundry 4.
“You”, “Your” refer to the client, user, or visitor engaging with our services.
“MVP” refers to the Minimum Viable Product delivered as part of our sprint offering.
2. Services
Foundry 4 provides design, development, and launch services for MVPs through structured 4-week sprints. Specific deliverables are agreed with clients before project commencement.
3. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to use our services.
4. Client Responsibilities
To ensure project success, clients agree to:
Provide accurate and timely information.
Participate in scheduled workshops, reviews, and feedback sessions.
Approve deliverables within agreed timelines.
Delays in providing required input may affect delivery dates and outcomes.
5. Payments and Fees
All fees are agreed in advance and payable as outlined in your proposal or invoice.
Payments must be made on time to avoid delays in project delivery.
Fees are non-refundable once work has commenced, unless otherwise agreed in writing.
6. Intellectual Property
Upon full payment, all deliverables created specifically for you (MVP designs, prototypes, code, and documentation) become your property.
Foundry 4 retains the right to showcase non-confidential elements of the work (e.g., case studies, portfolio).
7. Confidentiality
Both parties agree to keep confidential information secure and not disclose it to third parties without prior consent.
8. Limitation of Liability
We aim to deliver high-quality MVPs but cannot guarantee business success, funding, or customer adoption.
Foundry 4 shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services.
9. Termination
Either party may terminate a project with written notice if the other party breaches these Terms.
In case of termination, you remain liable for payment of all completed work up to the termination date.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the United Kingdom. Disputes shall be subject to the exclusive jurisdiction of UK courts.
11. Changes to Terms
We may update these Terms from time to time. Updates will be posted on this page with a revised “Updated” date.
